The Banner decision and its progeny have received a lot of criticism from practitioners who conduct internal investigations. What legitimate interests (and risks) – in addition to those related to preserving attorney-client privilege and work product protection – might justify a command to interviewed employees that they keep everything about the interview and surrounding investigation confidential?
